Credit life insurance in South Africa: cover, cost and your choices

In short: Credit life insurance is cover linked to a credit agreement. It can pay some or all of the outstanding debt after an insured event such as death, disability or loss of income, depending on the policy. A lender may require cover, but you can choose a qualifying policy of your own. Check exclusions, premiums and the benefit before signing.

What is credit life insurance?

A credit life policy is attached to a credit agreement and pays the lender if a covered event occurs. Where a lender requires cover under section 106, regulations set minimum benefits: death or permanent disability can settle the balance; temporary disability and unemployment cover obligations due for the shortest of 12 months, the remaining term, or until recovery or employment resumes. Exceptions apply, including to consumers unemployed when cover starts. Read Regulations 3 and 4.

Check the benefit schedule and exclusions before comparing offers. The regulations prescribe minimum benefits for lender-required cover, while eligibility and permitted exclusions depend on your circumstances and agreement. The National Credit Regulator's credit life insurance brochure explains that exclusions and limits apply, so the schedule and policy wording matter more than the label on a quote.

Look at who receives the claim money. A standard life policy usually pays its named beneficiary. Credit life pays the credit provider, up to the insured debt and subject to the agreement. For example, a claim is assessed against the balance and benefit when the event occurs, not simply the original amount borrowed. Ask the insurer what happens if its calculation is higher than the settlement figure.

Can a lender make credit life insurance a condition of a loan?

The short legal answer is yes, a credit provider can make insurance a condition of an agreement. Section 106 of the National Credit Act sets boundaries: the cover cannot exceed the outstanding obligations, and it cannot be unreasonable or unreasonably costly for the risk involved. The NCR's guideline on the Credit Life Insurance Regulations sets out these rights and how substitution works.

A lender may offer its own policy, but you must be told that you can waive that proposal and substitute a policy of your choice, provided the alternative meets the regulatory requirements. The lender must accept a compliant substitute and explain the applicable requirements in writing. Ask what minimum benefits, policy term and documents it requires before you submit the replacement.

A substitute is not simply any life policy you already own. The NCR guideline says the lender must accept a replacement if it complies with regulations 3 and 4; the cover and exclusions therefore need to match the regulatory requirements. For example, a family life policy that pays your spouse may not meet the credit agreement’s requirements, even if its insured amount looks large enough. Ask the lender to assess it before cancelling the proposed cover.

What does credit life insurance cover?

The minimum cover is specific, but the claim still depends on the rules and your situation. For example, the regulations permit exclusions from unemployment cover for resignation, retirement, lawful dismissal and some retrenchments, including notice received during the three months before cover begins. A consumer who was unemployed at policy start cannot be charged for unemployment-risk cover. Ask the insurer how your work arrangement is treated before relying on a job-loss benefit.

Ask the insurer which documents it would need for each claim type, and keep that list with the policy. A death claim and an involuntary job-loss claim will not use the same evidence; ask whether it needs an estate document, medical report or employer letter. Also ask when a benefit starts. A policy may pay instalments for a defined period rather than clear the balance, so the answer changes what protection your household actually has.

Some policies reduce the insured amount as the loan balance falls; others use a different benefit structure. A loan's repayment schedule is not enough to tell you what the policy will pay. Request a benefit schedule and compare it with the total amount you would owe over time, including interest and fees.

How much can credit life insurance cost?

For an unsecured personal loan, Regulation 3 caps the monthly premium at R4.50 per R1,000 of the deferred amount. For a credit facility such as a card or overdraft, the cap is R4.50 per R1,000 of average utilisation in the billing cycle. These ceilings include related fees and commissions; they are not standard prices, and a quote can be lower. The Credit Life Insurance Regulations published in the Government Gazette set these limits. Compare the premium with the benefit and exclusions, not by price alone.

Ask whether the premium is monthly or financed upfront. If it is added to the principal, interest may accrue on it too; compare the total repayable with and without cover.

Can I use my own insurance instead?

Yes, if it meets the statutory benefits and exclusions. Section 106 lets you waive the lender’s proposed policy; the NCR guideline says the lender must accept a qualifying substitute and explain the applicable requirements in writing.

Get the lender’s acceptance in writing before ending the existing cover. Check the replacement term and how the lender will be told if it lapses; otherwise you may leave the agreement uninsured.

When comparing loans, put the insurance cost beside interest and fees. A lower premium can still mean a more expensive loan overall. Check the provider in our NCR registration guide before sharing documents.

What should I check before signing?

Before signing, match the quote to the policy schedule: premium, insured events, waiting periods, exclusions and claim payee should be clear. Ask the lender to resolve any difference in writing.

Look at the repayment line, not just the premium box. If a quote adds a once-off premium to the amount borrowed, the instalment is calculated on a larger balance; ask for the total repayable with that cover included. Then compare it with a qualifying substitute on the same loan amount and term. This keeps the comparison useful even when one insurer quotes monthly and another quotes an upfront amount.

If you already have cover, ask whether it qualifies before cancelling anything. A financed premium adds to the amount you repay, so check the total cost as well as the monthly instalment.

What happens when I claim?

Contact the insurer or credit provider as soon as the insured event occurs and ask for the claim form and document list. Keep the claim reference and copies of everything you submit. Continue to follow the credit agreement while the claim is assessed unless the lender confirms in writing that payments are paused.

If a claim is declined, ask for the reason and the policy clause relied on. You can use the policy's complaints process and then escalate through the appropriate insurance ombud route. The lender's complaint channel may help with the credit agreement itself, but it cannot change an insurer's policy terms.

Will a credit life claim put cash in my bank account?

Usually the benefit is paid towards the credit agreement, not handed to you to spend. Ask the insurer for the payee and how it calculates the amount; compare that with the lender’s settlement figure.

Can I replace the lender’s policy with one I already have?

Possibly. The existing cover has to meet the applicable requirements and the lender must accept it before you drop the proposed policy. Get the decision and effective date in writing.

Does retrenchment count as job loss?

The regulations set a minimum unemployment benefit for lender-required credit life cover, subject to eligibility and permitted exclusions. For example, resignation and certain retrenchments can be excluded. Ask the insurer how your specific employment situation is treated before relying on the cover.

What should I do if a claim is declined?

Ask for the decision and the policy clause behind it in writing. Use the insurer’s complaint process and keep the claim number, submitted documents and response together.
